Important Disclaimer

Token Gym Kelly (TGK) is not a registered Financial Services Provider (FSP) as defined in the Financial Advisory and Intermediary Services Act, 2002 (FAIS Act).

1. No Financial Services

TGK does not provide financial advice, intermediary services, or investment recommendations of any kind. Our platform facilitates access to gym facilities through a prepaid token system.

2. Tokens Are Not Investments

TGK tokens are digital vouchers redeemable exclusively for gym access and platform services. Tokens are not securities, financial instruments, or investment products as defined under the Financial Markets Act, 2012 or the Collective Investment Schemes Control Act, 2002. Tokens hold no monetary value outside the TGK platform and cannot be traded, exchanged for cash, or treated as stored value under the National Payment System Act, 1998.

3. Consumer Protection

Your use of TGK is governed by the Consumer Protection Act, 2008 (CPA). Token purchases are final and non-refundable except as required under Section 56 of the CPA. Gym access is subject to each partner gym's terms and conditions.

4. FICA Compliance

Certain transactions on TGK may require verification under the Financial Intelligence Centre Act, 2001 (FICA). You may be asked to provide identification documents to comply with these requirements before accessing certain platform features.

5. POPIA & Data Privacy

TGK processes your personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Your data is used solely for platform operations and will not be shared with third parties without your consent, except as required by law.
